1. Introduction
This privacy notice describes how FP Digital Business Solutions Ltd with registered number 08975143 and registered address 74 Questor, Powder Mill Lane, Dartford, Kent, DA1 1EF ( “FP”, “We”, “Us” or “Our”) collects, uses, and discloses personal data and what choices you have regarding your personal data as a user of our services.

FP is committed to respecting and protecting your personal data.   This privacy policy outlines our commitment to ensuring privacy and security of your data, and sets out what information we collect from you, our policy also details how it is processed and when it is used, so please read the following carefully to understand our practices.

To the extent that information is associated with an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to as “personal data” in this privacy notice.

When we do so we are subject to the UK General Data Protection Regulation (UK GDPR).  We are also subject to the EU General Data Protection Regulation (EU GDPR) in relation to goods and services we offer to individuals in the European Economic Area (EEA), together with UK GDPR referred to as GDPR.

 

2. Applicability of this privacy notice
This privacy notice applies to all personal data collected or provided when you install or use the parcel tracking application “Parcel Shipping” (the “Application”) and the services we provide in connection with this Application (the “Services”), and when you visit our website: https://www.myfrancotyp.com/shipuk.

This privacy notice does not apply to third-party applications or software that integrate with the Services through our application (“Third Party Services”), or other third-party products, services or companies.

Access, provision and use of the Services is governed by a separate FPS Parcel Shipping Cloud Service Agreement with our customers (the “Customer Agreement”), including the processing of personal data or other content submitted through the Application (“Customer Data”).

 

3. Personal data and other data we process
We may process Customer Data and other information (“Other Information”) in various ways:

Customer Data. You may provide Customer Data to us when using the Services.  To create or update a Services Account in our Application, you provide us with a name and an email address or similar account information. For example, you may provide name and contact details, package information (weight, dimensions, shipping ID, tracking number), carrier and consignee information (name, contact details), charges and fees, transaction and package delivery information.

Other Information. We also collect, generate and receive the following Other Information:

(a) Application and Account information. In addition, the Customer may provide Us with billing information, such as Customer contact details, bank details, and address.

(b) Communications Data. We may send you Services, technical and other communications or contact you to inform you about changes to our Services and important Services-related communications, such as security and fraud notices; as well as to offer you additional services.

(c) Metadata about Services. When you interact with the Application and Services, metadata is generated that provides additional context about your actions for example, the types of Services used (if any);

(d) Log Data. Our servers automatically collect information when you visit or use our websites or Services and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before you used the website or Services, browser type and settings, browser configuration information and cookie information, the date and time the Services were used;

(e) Location data. We may receive information from your devices that helps us determine your approximate location. We may collect location data from devices in accordance with the consent process provided by your device and you may change this identifier in your device settings.

(f) Cookie Information. We use cookies and similar technologies in our websites and Services to help us collect Other Information. 4. What is our legal basis for processing your data?
Before we can process your personal information we must always ensure that we are complying with all applicable data protection legislation. Data protection law requires us to meet at least one “lawful reason” for processing your data.

The ground we intend to rely on is consent. If you have given your consent to our processing the data, then that is the basis on which we are processing it.

 

5. How we process your data
Customer Data is used and processed by us in accordance with your instructions, including any applicable terms in the Customer Agreement and Customer’s selection of the functionality of the Services. In relation to Customer Data, we are a processor and the Customer is the controller, who determines the purpose and means of processing Customer Data. For example, the Customer may grant and remove access to the Application, assign roles, access, share and modify Customer Data and otherwise apply its controls and policies to the Services.

We process Location Data only on the basis of consent and you can change this identifier in your device settings.

We use Other Information to protect our legitimate interests in operating Our Services, website and business. More specifically, we use Other Information for the following purposes:

– To provide, maintain and protect our Services. This includes using Other Information to support the provision of the Services under a Customer Agreement, prevent or address service errors, security or technical issues, analyse and monitor usage.

– To communicate with you by responding to your requests, comments and questions. If you contact us, we may use your Other Information to respond.

– For billing, account management and other administrative matters. We may need to contact you for billing purposes and use Application and Account Information to manage accounts and track billing and payments.

– To investigate and help prevent security problems and abuse.

 

6. How we share and disclose information
We may share and disclose Customer Data to carriers in accordance with your instructions, the terms of the Customer Agreement and the Customer’s selected functionality of the Services.

When the Customer’s authorised user submits personal data in the Application, it may be displayed to other of Customer’s authorised users in the Application. For example, the authorised user’s name and email address may be displayed with their profile.  Representatives of the Customer (administrators) and authorised users of the Customer may access, modify or restrict Customer Data.

We may engage third parties as service providers or business partners to process personal data and support our business. For example, these third parties may provide storage services. We may also share personal data with our affiliates, parent companies and/or subsidiaries for marketing purposes unless you object in the Application or otherwise.

Where personal data is shared with third parties We take the measures necessary to ensure that such companies process personal data according to the security measures required under applicable data protection legislation.

We may disclose Customer Data or other information if we reasonably believe it is consistent with our legitimate interest or required by applicable law, regulation or legal process. We may disclose customer data or other information to protect and defend the rights or property or our users or third parties; or in connection with the investigation and prevention of illegal activity, fraud or security issues, including the prevention of harm.

We will not disclose more personal data than necessary for the purpose of disclosure and in compliance with regulatory and data protection laws.

 

7. Retention of data
We retain personal data and Customer Data only for as long as necessary for the purposes set out in this privacy notice or as required by regulatory or data protection legislation.

We may retain Other Information for as long as necessary for the purposes described in this privacy notice. This may include retaining your Other Information after you deactivate your Services Account for the period necessary to pursue legitimate business interests, comply with legal obligations, resolve disputes and enforce our agreements.

 

8. Your rights
You have certain legal rights regarding the processing of your personal data.

You have the right to:

• delete your personal information subject to certain exceptions provided by law such as (but not limited to) our compliance requirements from a legal perspective to protect against illegal activities. We are legally required to process your personal data in cases where we need to respond to certain requests by government or law enforcement authorities;

• withdraw your consent to our processing of your personal data;

• access a copy of your personal data;

• restrict the processing of your personal data; and

• correct any incorrect information in your personal data.

You can usually exercise these rights through the settings in your Services account. If you cannot use the settings, please contact FP as set out below for additional access and assistance.  In this case we will respond to your request in a reasonable timeframe but please note that we may need to obtain further information to verify your identity before we can comply with your request.

 

9. Where your personal data is stored
Personal data is stored and processed in Germany and the UK.

 

10. Transferring your personal data out of your country
We do not transfer personal data outside the European Economic Area (EEA).

As we store your personal data in the EEA (Germany) we will transfer your personal data from UK to the EEA.

Under data protection laws, we can transfer your personal data to the EEA from the UK because the UK has decided that the EEA ensures an adequate level of protection of personal data (through an ‘adequacy regulation’) further to Article 45 of the UK GDPR.

In the event we cannot or choose not to continue to rely on this adequacy regulation we will not transfer your personal data outside the UK unless we can do so on the basis of an alternative mechanism or exception provided by applicable data protection law and reflected in an update to this policy.

Any changes to the destinations to which we send personal data or in the transfer mechanisms we rely on to transfer personal data internationally will be notified to you in accordance with the section on ‘Changes to this privacy policy’ below.

We may change this privacy notice from time to time. Laws, regulations and industry standards evolve, so these changes may be necessary, or we may make changes to our services. If we make changes that materially affect your privacy rights, we will notify you additionally, for example via email or through the Application. If you disagree with the changes in this privacy notice, you should deactivate your Service account.
